班智达智能用户服务协议

引言

欢迎您注册并使用由青海师范大学班智达团队研发和运营的班智达智能！我们将根据本《用户服务协议》（以下简称"本协议"）提供您在班智达智能App、小程序以及线上平台服务。

为使用我们的服务，请您务必审慎阅读、充分理解本协议各条款内容。您点击班智达智能页面上的"我已阅读并同意遵守《用户服务协议》和《隐私政策》"或您进行注册、使用、获取用户账号、登录及使用相关服务的行为或者以其他任何明示表示接受本协议的，均视为您已阅读并同意签署本协议，本协议即构成对您和我们有约束力的法律文件。如果您不同意本协议的条款，请停止注册、登录班智达智能平台。如果您因年龄、智力等因素而不具有完全民事行为能力，请在法定监护人的陪同下阅读和签署本协议。

一、定义与解释

如无特别说明，下列术语在本协议中的定义为：

1.1 用户是指注册、登录、使用班智达智能的个人，在本协议中更多地称为"您"。
1.2 班智达智能是您通过"实人+实名"身份认证核验，即可使用多项自然语言处理事项的服务平台，平台形式包括班智达智能App、小程序以及网页版（banzhida.com），提供9款自然语言处理服务功能，具体包括：（1）班智达AI；（2）班智达翻译；（3）班智达词典；（4）班智达文献；（5）班智达识别；（6）班智达藏医；（7）班智达图译；（8）班智达语音翻译；（9）班智达听书。
1.3 账号是指您通过手机号码、微信等方式注册的，用于登录班智达智能App、小程序以及网页版的账号。

二、协议适用范围

2.1 本协议是我们制定的关于您获取和使用班智达智能账号的相关规则。本规则适用于由班智达智能App、小程序以及网页版提供的需要注册或使用账号的全部软件或服务。
2.2 班智达智能拥有banzhida.com及其涉及到的产品、相关软件的所有权和运作权，班智达智能享有对其产品的一切活动的监督、提示、检查、纠正及处罚等权利。

三、账号注册及管理

3.1 账号注册

您可选择直接通过微信等第三方方式注册账号，您也可选择直接通过手机号注册账号。新用户在通过实名认证验证身份方式，以及我们向您提供的通过第三方方式登录时，系统将为您自动匹配一个账号，账号密码由您第一次登录后自行设置并由您负责保管。您在注册及使用我们提供的服务时，必须提供真实、准确、完整、合法有效的资料、信息等。

您不得冒用他人（包括个人、组织）身份信息申请非本人的用户账号。如有违反，经核实后，我们有权删除其账号。对于冒用他人身份信息申请非本人的用户账号而引起的一切责任，由冒用者承担。

3.2 账号管理

3.2.1 班智达智能账号的所有权归青海师范大学班智达智能团队所有，用户完成申请注册手续后，仅获得账号的使用权，且该使用权仅属于初始申请注册人。
3.2.2 我们将经过用户同意的情况下用户自行填写的方式收集用户的基础信息，如姓名、性别和年龄等用于统计用户工作量的统计，且仅限于统计工作量。本应用不会获取用户的位置信息等隐私信息。
3.2.3 您有责任妥善保管注册账号信息及账号密码的安全，您需要对您注册账号以及密码下的行为承担法律责任。当在您知悉您的账号已经失密或者可能已经失密时，您应立即通知我们并在平台上修改密码。
3.2.4 您确认只有您本人可以使用您的账号，用户账号和密码不得出借、转让、继承或者赠与。在您决定不再使用该账号时，您应在班智达智能App、小程序或者网页版申请注销该账号。您应对因您未能遵守本款约定而发生的任何损失、损毁及其他不利后果负责。
3.2.5 如果您当前使用的账号并不是您初始申请注册的或者非通过正规途径获得的，您应立即停止使用该账号登录或进行任何操作，并请您在第一时间通知我们，若由于您未及时通知班智达智能且违规操作所产生一切的不利后果，将由您承担全部责任。
3.2.6 如您违反相关法律法规、本协议或其他相关协议、规则，我们有权限制、中止、冻结或终止您对账号全部或部分服务内容的使用，且根据实际情况决定是否恢复您对账号的正常使用，而由此产生的损失由您自行承担。

四、用户个人信息保护

4.1 我们非常重视对您个人信息的保护。我们将按照本协议及班智达智能《隐私政策》的规定收集、使用、存储、分享和披露您的个人信息。本协议对个人信息保护规定的内容与上述《隐私政策》有相冲突的，及本协议对个人信息保护相关内容未作明确规定的，均应以单独制定的《隐私政策》内容为准。
4.2 如您认为您的个人信息被超出使用目的范围收集、使用、或被其他用户侵权，请立即与我们联系，并按照要求提供相应的证明资料，我们将及时调查核实处理。
4.3 一般情况下，您可随时浏览、修改自己提交的信息，但出于安全性和身份识别的考虑，您可能无法修改注册时提供的初始注册信息及其他验证信息。
4.4 我们将运用各种安全技术和程序建立完善的管理制度来保护您的个人信息，以免遭受未经授权的访问、使用或披露。
4.5 对于我们会如何收集、使用、存储和保护您的个人信息及您享有何种权利，您还可以阅读《隐私政策》予以进一步了解，请您知悉，《隐私政策》为本协议重要的组成部分。

五、用户行为规范

5.1 您不得因非正常使用服务之目的恶意注册、获取账号。若经过我们判断，认为您使用的账号是恶意注册、获取的账号，我们有权对相应账号采取限制、中止、冻结或终止使用等措施。
5.2 您在使用服务时，须通过我们提供的登录页面及其他合法通道等进行班智达智能账号和密码输入、个人信息授权等操作；否则，由此所造成的账号、密码泄漏或其他损失等由您自行承担。
5.3 您在使用我们提供的服务过程中，必须遵循法律法规、规章、规范性文件及政策要求的规定，遵守所有与平台、网络服务有关的网络协议、规定和程序，并不得利用班智达智能App、小程序以及网页版从事以下行为：
1. （1）反对宪法所确定的基本原则的；
2. （2）危害国家安全，泄露国家秘密，颠覆国家政权，破坏国家统一的；
3. （3）损害国家荣誉和利益的；
4. （4）煽动民族仇恨、民族歧视，破坏民族团结的；
5. （5）破坏国家宗教政策，宣扬邪教和封建迷信的；
6. （6）散布谣言，扰乱社会秩序，破坏社会稳定的；
7. （7）散布淫秽、色情、赌博、暴力、凶杀、恐怖或者教唆犯罪的；
8. （8）侮辱或者诽谤他人，侵害他人合法权益的；
9. （9）含有法律、行政法规禁止的其他内容的。
5.4 您充分了解并同意，您必须为自己注册账号下的一切行为负责，包括您所发表的任何内容、您进行的各项操作、您进行的授权以及由此产生的任何后果。
5.5 服务提供方有权对用户使用班智达智能产品的情况进行审查和监督，如用户在使用班智达智能产品时违反任何上述规定，班智达智能或其授权的人有权要求用户改正或直接采取一切必要的措施以减轻用户不当行为造成的影响。
5.6 盗取他人用户账号或利用网络通讯骚扰他人，均属于非法行为。用户不得采用测试、欺骗等任何非法手段，盗取其他用户的账号和对他人进行骚扰。

六、知识产权声明

6.1 班智达智能在服务中提供的任何内容、功能和服务的著作权、商标权、专利权、商业秘密等知识产权均受中华人民共和国法律法规和相应的国际条约保护，青海师范大学班智达智能团队享有上述知识产权，但相关权利人依照法律规定应享有的权利除外。
6.2 未经我们或相关权利人书面同意，您不得为任何商业或非商业目的自行或许可任何第三方实施、利用、转让上述知识产权。

七、风险及免责

7.1 班智达智能不能对用户在本软件中班智达AI、翻译、词典、文献、识别、藏医、图译和听书的知识输出准确性及合理性进行保证。
7.2 对于因不可抗力或班智达智能不能控制的原因造成的网络服务中断或其它缺陷，班智达智能不承担任何责任，但将尽力减少因此而给用户造成的损失和影响。
7.3 由于互联网本身所具有的不稳定性，班智达智能无法保证服务不会中断。您在使用班智达智能提供的服务时，须自行承担如下班智达智能不可掌控的风险内容，包括但不限于：（1）系统停机维护期间；（2）电信设备出现故障不能进行数据传输的；（3）由于网络供应商技术调整或故障、网站升级方面的问题等原因而造成的服务中断或延迟；（4）您的电脑软件、系统、硬件和通信线路出现故障；（5）您操作不当或通过非天府通办授权的方式使用本服务；（6）因受到计算机病毒、木马或其他恶意程序、黑客攻击的破坏、台风、地震、海啸、洪水、停电、战争、恐怖袭击等不可抗力之因素，造成系统障碍不能执行业务的；（7）其他无法控制或合理预见的情形。
7.4 因您的过错导致的任何损失由您自行承担，该过错包括但不限于：不按照提示操作，未及时进行操作，遗忘或泄漏密码、校验码等，密码被他人破解，您使用的计算机或其他硬件、终端等被他人侵入或丢失，或您使用的软件被他人侵入等。
7.5 用户同意保障和维护班智达智能及其他用户的利益，用户在班智达智能发表的内容仅表明其个人的意见和观点。由于用户发表内容违法、不真实、不正当、侵犯第三方合法权益，或用户违反本协议项下的任何条款而给班智达智能或任何其他第三人造成损失，用户需承担由此造成的损害赔偿责任，班智达智能团队不承担任何责任。

八、法律责任

8.1 您理解并同意，我们有权依合理判断对违反有关法律法规或本协议规定的行为追究责任，对违法违规的任何人士采取适当的法律行动，并依据法律法规保存有关信息向有关部门报告等，您应独自承担由此而产生的一切法律责任。
8.2 您理解并同意，因您违反本协议或相关服务条款的规定，导致任何索赔、要求或损失，您应当独立承担责任；班智达智能因此遭受损失的，您也应当一并赔偿。

九、协议的更新、变更

9.1 协议的更新

班智达智能会在必要时修改服务条款，服务条款一旦发生变动，班智达智能将会在用户进入下一步使用前的页面提示修改内容。如果您同意改动，请再一次激活"我同意"按钮。如果您不接受，请及时取消您的帐户。用户要继续使用班智达智能各项服务需要两方面的确认：（1）首先确认班智达智能服务条款及其变动；（2）同意接受所有的服务条款限制。

9.2 协议的签署形式

如您对本协议条款内容有任何疑问，可向我们咨询。一旦点击"同意"或"接受"或"注册"按钮并成功注册，则与我们之间形成协议关系，应当受本协议条款的约束。

十、法律适用及管辖

10.1 本协议的签订地为青海省西宁市城西区五四西路38号（青海师范大学城西校区）。
10.2 本协议的订立、变更、执行和解释，以及与本协议有关的争议解决，均应适用中华人民共和国法律。如与本协议有关的某一特定事项没有法律规定或规定不明确，则应参照通用的国际商业惯例和行业惯例。

十一、IMEI使用说明

我们在未获得用户明确许可的情况下，广告标识符(IMEI)不会与个人身份信息或任何永久性设备标识符相关联。同意选项如下：

（1）您同意让第三方共享资料；
（2）您同意公开你的个人资料，享受为您提供的产品和服务；
（3）本站需要听从法庭传票、法律命令或遵循法律程序；
（4）本站发现您违反了本站服务条款或本站其它使用规定。

Banzhida Intelligent User Service Agreement

Introduction

Welcome to register and use Banzhida Intelligent, developed and operated by the Banzhida Team of Qinghai Normal University! We will provide you with services on the Banzhida Intelligent App, Mini Program, and online platform according to this "User Service Agreement" (hereinafter referred to as "this Agreement").

To use our services, please carefully read and fully understand all terms of this Agreement. By clicking "I have read and agree to comply with the 'User Service Agreement' and 'Privacy Policy'" on the Banzhida Intelligent page, or by registering, using, obtaining a user account, logging in, using related services, or expressing acceptance of this Agreement in any other explicit way, you are deemed to have read and agreed to sign this Agreement, which constitutes a legally binding document for both you and us. If you do not agree to the terms of this Agreement, please stop registering or logging into the Banzhida Intelligent platform. If you lack full civil capacity due to age, intelligence, or other factors, please read and sign this Agreement accompanied by your legal guardian.

I. Definitions and Interpretations

Unless otherwise specified, the following terms in this Agreement are defined as:

1.1 User refers to individuals who register, log in, and use Banzhida Intelligent, more commonly referred to as "you" in this Agreement.
1.2 Banzhida Intelligent is a service platform where you can use multiple natural language processing services after verification through "real person + real name" identity authentication. The platform forms include Banzhida Intelligent App, Mini Program, and web version (banzhida.com), providing 9 natural language processing service functions, specifically including: (1) Banzhida AI; (2) Banzhida Translate; (3) Banzhida Dictionary; (4) Banzhida Literature; (5) Banzhida OCR; (6) Banzhida Tib_Medicine; (7) Banzhida IMG_OCR; (8) Banzhida Phonetic Translation; (9) Banzhida Audiobook.
1.3 Account refers to the account you register through mobile phone number, WeChat, or other methods, used to log in to the Banzhida Intelligent App, Mini Program, and web version.

II. Scope of Agreement Application

2.1 This Agreement is our set of rules regarding your acquisition and use of Banzhida Intelligent accounts. These rules apply to all software or services provided by the Banzhida Intelligent App, Mini Program, and web version that require registration or use of an account.
2.2 Banzhida Intelligent owns banzhida.com and its related products and software, and Banzhida Intelligent has the rights to supervise, prompt, inspect, correct, and penalize all activities related to its products.

III. Account Registration and Management

3.1 Account Registration

You may choose to register an account directly through third-party methods such as WeChat, or you may choose to register an account directly through a mobile phone number. When new users verify their identity through real-name authentication and when we provide you with third-party login methods, the system will automatically match an account for you. You are responsible for setting and safeguarding your account password after your first login. When registering and using our services, you must provide true, accurate, complete, legal, and valid information.

You may not impersonate others (including individuals or organizations) to apply for user accounts that do not belong to you. If violated, after verification, we have the right to delete the account. The impersonator shall bear all responsibilities arising from impersonating others' identity information to apply for user accounts that do not belong to them.

3.2 Account Management

3.2.1 The ownership of Banzhida Intelligent accounts belongs to the Banzhida Intelligent Team of Qinghai Normal University. After completing the application and registration procedures, users only obtain the right to use the account, and this right of use belongs only to the initial applicant.
3.2.2 With user consent, we will collect users' basic information, such as name, gender, and age, through user self-filling methods for statistical purposes of workload, and limited to workload statistics only. This application will not obtain users' private information such as location information.
3.2.3 You are responsible for properly safeguarding your registration account information and account password security. You need to take legal responsibility for actions under your registered account and password. When you know or suspect that your account has been compromised, you should immediately notify us and change your password on the platform.
3.2.4 You confirm that only you can use your account. User accounts and passwords may not be lent, transferred, inherited, or given away. When you decide to no longer use the account, you should apply to cancel the account through the Banzhida Intelligent App, Mini Program, or web version. You shall be responsible for any losses, damages, and other adverse consequences that may occur due to your failure to comply with this provision.
3.2.5 If the account you are currently using is not the one you initially registered or was not obtained through proper channels, you should immediately stop using that account to log in or perform any operations, and please notify us at the earliest opportunity. If you fail to promptly notify Banzhida Intelligent and perform unauthorized operations, you will bear all responsibility for any adverse consequences.
3.2.6 If you violate relevant laws and regulations, this Agreement, or other related agreements and rules, we have the right to restrict, suspend, freeze, or terminate your use of all or part of the account services, and decide whether to restore your normal use of the account based on the actual situation. Any losses arising therefrom shall be borne by you.

IV. Protection of User Personal Information

4.1 We attach great importance to the protection of your personal information. We will collect, use, store, share, and disclose your personal information in accordance with this Agreement and Banzhida Intelligent's "Privacy Policy." If there is any conflict between the provisions on personal information protection in this Agreement and the aforementioned "Privacy Policy," or if this Agreement does not clearly stipulate related content on personal information protection, the content of the separately formulated "Privacy Policy" shall prevail.
4.2 If you believe your personal information has been collected or used beyond the scope of the purpose, or has been infringed upon by other users, please contact us immediately and provide the required supporting documentation as requested. We will promptly investigate and address the issue.
4.3 Generally, you can browse and modify the information you submit at any time, but for security and identity verification considerations, you may not be able to modify the initial registration information and other verification information provided during registration.
4.4 We will employ various security technologies and procedures to establish a comprehensive management system to protect your personal information from unauthorized access, use, or disclosure.
4.5 For more information on how we collect, use, store, and protect your personal information and what rights you enjoy, you can read the "Privacy Policy" for further understanding. Please be aware that the "Privacy Policy" is an important component of this Agreement.

V. User Behavior Standards

5.1 You may not maliciously register or obtain accounts for purposes other than normal service use. If we determine that the account you are using was maliciously registered or obtained, we have the right to take measures such as restricting, suspending, freezing, or terminating the use of the corresponding account.
5.2 When using the service, you must enter your Banzhida Intelligent account and password, authorize personal information, and perform other operations through the login page provided by us and other legal channels; otherwise, you shall bear any account or password leakage or other losses caused thereby.
5.3 When using the services we provide, you must comply with the provisions of laws, regulations, rules, normative documents, and policy requirements, abide by all network protocols, regulations, and procedures related to the platform and network services, and must not use the Banzhida Intelligent App, Mini Program, or web version to engage in the following activities:
1. (1) opposing the basic principles established by the Constitution;
2. (2) endangering national security, leaking state secrets, subverting state power, or undermining national unity;
3. (3) harming national honor and interests;
4. (4) inciting ethnic hatred, ethnic discrimination, or undermining ethnic unity;
5. (5) undermining the state's religious policy or promoting cults and feudal superstitions;
6. (6) spreading rumors, disrupting social order, or undermining social stability;
7. (7) spreading obscenity, pornography, gambling, violence, murder, terror, or instigating crimes;
8. (8) insulting or defaming others, or infringing upon others' legitimate rights and interests;
9. (9) containing other content prohibited by laws and administrative regulations.
5.4 You fully understand and agree that you must be responsible for all actions under your registered account, including any content you publish, operations you perform, authorizations you grant, and any consequences arising therefrom.
5.5 The service provider has the right to review and supervise users' use of Banzhida Intelligent products. If users violate any of the above regulations when using Banzhida Intelligent products, Banzhida Intelligent or its authorized personnel have the right to require users to correct or directly take all necessary measures to mitigate the impact caused by users' improper behavior.
5.6 Stealing other users' accounts or using network communications to harass others are illegal activities. Users must not use testing, deception, or any other illegal means to steal other users' accounts or harass others.

VI. Intellectual Property Statement

6.1 The copyright, trademark rights, patent rights, trade secrets, and other intellectual property rights of any content, functions, and services provided by Banzhida Intelligent in its services are protected by the laws and regulations of the People's Republic of China and corresponding international treaties. The Banzhida Intelligent Team of Qinghai Normal University enjoys the above intellectual property rights, except for the rights that relevant rights holders should enjoy according to legal provisions.
6.2 Without the written consent of us or relevant rights holders, you may not implement, utilize, or transfer the above intellectual property rights by yourself or license any third party for any commercial or non-commercial purpose.

VII. Risks and Disclaimers

7.1 Banzhida Intelligent cannot guarantee the accuracy and reasonableness of knowledge output in Banzhida AI, Translation, Dictionary, Literature, OCR, Tib_Medicine, IMG_OCR, and Audiobook within this software.
7.2 Banzhida Intelligent assumes no responsibility for network service interruptions or other defects caused by force majeure or reasons beyond Banzhida Intelligent's control but will strive to reduce the losses and impacts caused to users.
7.3 Due to the inherent instability of the Internet, Banzhida Intelligent cannot guarantee that services will not be interrupted. When using the services provided by Banzhida Intelligent, you must bear the following risks that Banzhida Intelligent cannot control, including but not limited to: (1) system downtime during maintenance periods; (2) telecommunications equipment failures that prevent data transmission; (3) service interruptions or delays caused by network provider technical adjustments or failures, website upgrades, and other issues; (4) failures in your computer software, system, hardware, or communication lines; (5) improper operations by you or use of this service through means not authorized by Tianfu Tong Ban; (6) system failures that prevent business execution due to computer viruses, Trojans or other malicious programs, hacker attacks, typhoons, earthquakes, tsunamis, floods, power outages, wars, terrorist attacks, and other force majeure factors; (7) other uncontrollable or reasonably unforeseeable circumstances.
7.4 Any losses caused by your mistakes shall be borne by you. Such mistakes include but are not limited to: not operating according to prompts, not operating in a timely manner, forgetting or leaking passwords or verification codes, passwords being cracked by others, computers or other hardware or terminals you use being invaded or lost, or software you use being invaded, etc.
7.5 Users agree to protect and maintain the interests of Banzhida Intelligent and other users. The content published by users on Banzhida Intelligent only represents their personal opinions and views. If users publish content that is illegal, untrue, improper, or infringes on the legitimate rights and interests of third parties, or if users violate any terms under this Agreement, causing losses to Banzhida Intelligent or any other third party, users shall bear the resulting damage compensation liability, and the Banzhida Intelligent Team assumes no responsibility.

Ⅷ. Legal Liability

8.1 You understand and agree that we have the right to pursue responsibility for actions that violate relevant laws, regulations, or the provisions of this Agreement based on reasonable judgment, to take appropriate legal action against any person who violates laws and regulations, and to retain relevant information and report to relevant departments in accordance with laws and regulations. You shall independently bear all legal liabilities arising therefrom.
8.2 You understand and agree that if you violate this Agreement or related service terms, resulting in any claims, demands, or losses, you should independently bear responsibility; if Banzhida Intelligent suffers losses as a result, you should also compensate for those losses.

Ⅸ. Agreement Updates and Changes

9.1 Agreement Updates

Banzhida Intelligent will modify the service terms when necessary. Once the service terms change, Banzhida Intelligent will prompt the modified content on the page before users proceed to the next step. If you agree to the changes, please activate the "I agree" button again. If you do not accept, please cancel your account promptly. Users need to confirm two aspects to continue using Banzhida Intelligent's services: (1) first, confirm Banzhida Intelligent's service terms and their changes; (2) agree to accept all service term restrictions.

9.2 Form of Agreement Signing

If you have any questions about the content of this Agreement, you can consult us. Once you click the "agree" or "accept" or "register" button and successfully register, an agreement relationship is formed between us, and you should be bound by the terms of this Agreement.

X. Applicable Law and Jurisdiction

10.1 The signing place of this Agreement is No. 38 Wusi West Road, Chengxi District, Xining City, Qinghai Province (West Campus of Qinghai Normal University).
10.2 The conclusion, modification, execution, and interpretation of this Agreement, as well as the resolution of disputes related to this Agreement, shall be governed by the laws of the People's Republic of China. If there are no legal provisions or unclear provisions for a specific matter related to this Agreement, reference should be made to general international commercial practices and industry practices.

XI. IMEI Usage Statement

Without obtaining explicit user permission, the advertising identifier (IMEI) will not be associated with personal identity information or any permanent device identifier. The consent options are as follows:

(1) You agree to let third parties share materials;
(2) You agree to disclose your personal information to enjoy the products and services provided to you;
(3) This site needs to comply with court subpoenas, legal orders, or legal procedures;
(4) This site discovers that you have violated this site's service terms or other usage regulations.

(1) ཁྱེད་རང་ཕྱོགས་གསུམ་པས་ཆ་འཕྲིན་མཉམ་སྤྱོད་བྱེད་པར་མོས་མཐུན་ཡོད།
